Ajuste de Estatus (245-I)

Proceso mediante el cual una persona que ya se encuentra dentro de EE.UU. puede solicitar la residencia permanente legal. Podría calificar quien tiene una petición familiar o certificación laboral presentada entre el 15 de enero de 1998 y del 30 de abril de 2001, incluso si entró al país sin documentos.

Advance Parole

Permiso especial que permite a ciertos inmigrantes con trámites pendientes (como Ajuste de Estatus, DACA o TPS) salir y regresar a EE.UU. sin que se considere abandonado su proceso migratorio.
Aunque no es una visa ni garantiza la entrada, protege su estatus migratorio al momento de reingresar.

Ajuste de Estatus (I-485)

Proceso que solo pueden presentar personas que entraron legalmente al país. Se utiliza cuando ya hay una petición aprobada (familiar, laboral o humanitaria) y una visa disponible.

Ciudadanía y Naturalización

Cumpliendo ciertos requisitos como tener la residencia permanente, haber vivido en el país durante un periodo determinado, demostrar buen carácter moral y aprobar los exámenes de inglés y educación cívica.

Perdones migratorios (waivers)

Una excepción legal que permite a ciertos inmigrantes superar causas de inadmisibilidad y solicitar una visa o residencia. En muchos casos, se requiere probar que negarlo causaría un perjuicio extremo a un familiar.

Son solicitudes que ciudadanos o residentes permanentes de EE.UU. presentan para ayudar a ciertos familiares a obtener un estatus migratorio legal, los requisitos varían según el tipo de parentesco y el estatus del peticionario.

Proceso Consular
Renovación de DACA

Es el proceso que permite a una persona fuera de EE.UU. (o que no califica para ajustar estatus dentro del país) solicitar una visa de inmigrante en un consulado o embajada estadounidense, con el fin de ingresar legalmente como residente permanente.

El programa de Acción Diferida para los Llegados en la Infancia (DACA) es una política migratoria implementada en 2012. Quienes renuevan pueden extender su protección contra la deportación y un permiso de trabajo por 2 años más.
